These Terms & Conditions ("Terms") govern your use of the NoMoreQuiting application ("the App", "the Service"), including all of its features: workout tracking, personal statistics, the social layer (friends, followers, leaderboard), gamification and achievements, visual customization, and the support ticket system. By creating an account or using the App, you confirm that you have read, understood, and agree to these Terms. If you don't agree, please don't use the App.

1. What the service does

NoMoreQuiting is a personal workout-tracking app with a social fitness layer. Its main features include:

  • creating your own workout categories from an exercise catalog maintained by the app's team;
  • logging sets (weight, reps) live during a workout, with the option to abandon or finalize the session;
  • recurring scheduling of workout categories and an activity calendar;
  • Fitness activity tracking (running, walking, cycling, etc.) via live GPS or manual (treadmill/indoor) entry - distance, duration, pace, and elevation;
  • personal statistics, lifted-volume progress, and body weight history;
  • a social layer: friend requests, following, blocking, a public profile with configurable visibility, and a friends leaderboard ranked by lifted volume or distance covered;
  • achievements unlocked automatically as you use the app, displayable on your profile;
  • optional two-factor authentication (2FA) via an authenticator app;
  • visual theme customization (colors, dark/light mode, a gamified menu);
  • a support ticket system with categories (Support, Feature request, Bug report, Legal, Other), file attachments (Word documents, PDFs, or images), and the ability to continue the conversation either in-app or by replying to email.

The App is provided "as is," without any guarantee of uninterrupted or error-free availability. Features may be changed, added, or removed as the App evolves.

2. Who can use the App

The App is not intended for, and may not be used by, anyone under 18 years of age. When creating an account, you must explicitly certify that you are at least 18. If we learn that an account belongs to someone under 18, we reserve the right to immediately suspend or delete it, along with all associated data.

3. Your account

You're responsible for keeping your account password confidential and for everything that happens under your account. Information you provide at registration (username, email) must be accurate. The App allows a single active session per account - logging in on a new device automatically signs the previous one out. We recommend enabling two-factor authentication for extra security. We reserve the right to suspend or close accounts that are used abusively, fraudulently, or in violation of these Terms.

4. Not medical advice

NoMoreQuiting is a tool for recording your own workout data, not a source of personalized medical, nutritional, or fitness guidance. Consult a doctor or a qualified professional before starting any exercise program, especially if you have a pre-existing medical condition. You use the App and its information at your own risk.

5. Location tracking for Fitness activities

Live (GPS) tracking for Fitness activities uses your device's location. Before tracking starts, your browser will explicitly ask for permission to access your location - tracking only happens if you grant that permission, and only while an activity is actively being tracked. You can always log an activity manually instead (e.g. a treadmill session) without using GPS at all. Full details on what location data we collect, how long we keep it, and how we protect it are in the Privacy Policy.

A GPS-tracked route can reveal sensitive information - for example, the start or end point of a run from home can indicate your address. The visibility of your routes and activities follows your profile's visibility settings (see the Privacy Policy), and you are solely responsible for choosing the visibility level of your activities and profile - the App does not and cannot automatically detect or hide whatever part of a route might be sensitive.

6. The social layer and content you share

By using the social features (public profile, friends, followers, leaderboard), certain information about you (username, avatar, achievements, workout volume) may become visible to other users, depending on the visibility settings you choose for your profile. You are solely responsible for the content you send through support tickets (including attached files) or any other interaction within the App - it must not be illegal, offensive, infringe on another person's rights, or contain harmful software.

7. Your content and intellectual property

By uploading a profile picture or any other content to the App, you grant us a non-exclusive, royalty-free, worldwide license to display it solely within the App. You represent and warrant that you own all intellectual property rights to the content, or have obtained all necessary licenses or permissions to use it and upload it to us. You agree to indemnify and hold us harmless from any third-party claims resulting from your uploaded content.

8. Support tickets, attachments, and communication

You can reach the app's team through the in-app support ticket system. When opening a ticket, you may attach Word document, PDF, or image files, up to 10 MB per file and up to 5 files per message; any other file type is rejected automatically regardless of the declared extension. The conversation can continue either directly in the App or by replying to the emails you receive - both update the same ticket. A Support or Other ticket left without any response from you for 7 days after the last reply closes automatically; Bug report and Feature request tickets never auto-close and may instead be moved by the team into an internal tracking list once evaluated or resolved; Legal tickets never auto-close.

Anything you choose to send through a support ticket (including personal data we didn't ask you for) is sent entirely at your own risk - we are not responsible for any consequence of including such information in a ticket. If content sent through a ticket appears to be illegal (for example, child sexual abuse material or any other content prohibited by law), we will report it to the relevant authorities.

9. Prohibited conduct and impersonation

You agree not to use the App to: break the law; attempt unauthorized access to other users' accounts or to the systems hosting the Service; disrupt the App's normal operation or circumvent the rate limits put in place for protection; harass, intimidate, or abuse other users through the social features or the support ticket system; upload harmful files or files that infringe copyright; or create multiple accounts for fraudulent purposes.

You agree that you will not misrepresent your identity, impersonate any real person or entity, or create an account for anyone other than yourself. We reserve the right, at our sole discretion, to immediately suspend or permanently delete any account that engages in identity fraud, deceptive behavior, or impersonation.

10. Roles and administration

Some accounts carry administrative roles (Admin, Moderator, Founder) that grant access to additional functionality: managing the exercise catalog and muscle groups, administering other admin accounts, and managing every user's support tickets. Relevant administrative actions are recorded in an audit log for security and accountability.

11. Ownership

The exercise catalog, muscle groups, their associated images, and the App's code remain the property of the team building NoMoreQuiting. The workout data you enter belongs to you - you can request it at any time under the Privacy Policy. Rights to content you upload (such as your avatar) remain yours, subject to the license granted in section 7 above.

How we collect, use, and protect your data is described in full in the Privacy Policy, which forms part of these Terms.

13. Ending your use

You may stop using the App at any time. You can permanently delete your account yourself from Account Settings, which requires typing your username to confirm and a short waiting period before the delete button becomes available, as a safeguard against an accidental click. Deleting your account removes your workouts, activities, categories, achievements, social connections, and every other record tied to it. We keep only your username, user ID, and email - solely to prevent immediate re-registration and to meet the legal retention obligations described in the Privacy Policy - and your password is invalidated, so nobody, including us, can log in as you again. Support tickets are kept after deletion for legal-defense and abuse-history purposes, per section 8. We reserve the right to suspend or close accounts that violate these Terms, with or without prior notice, depending on the severity of the violation.

14. Notice and action (copyright, impersonation, abuse)

If you believe a profile picture or other content unlawfully uses your copyright-protected material, or that an account is impersonating you or someone else, please contact us through a support ticket in the Legal category, or at support+legal@nomorequiting.com, with a description of the issue and, if possible, a link or screenshot of the profile in question. We will review the report and, if it's well-founded, promptly remove or disable the content or account.

If your account was affected by such an action and you believe the report was mistaken, you can contact us the same way to dispute it (a "counter-notice"). If the person who filed the original report wants to pursue the matter further, they will need to do so through the courts - we remain neutral and legally protected as long as we acted in good faith based on the information we received.

15. Limitation of liability and dispute resolution

To the maximum extent permitted by law, the App is provided without warranties of any kind, express or implied. We are not liable for indirect, incidental, or consequential losses arising from your use of, or inability to use, the Service, including any injury resulting from following a workout program of your own choosing, or from content other users upload or send (including profile pictures or content that infringes a third party's rights or impersonates someone). In any case, our total liability to you, regardless of cause, will not exceed whatever amount you paid (if any) to use the App in the preceding 12 months.

Any dispute relating to these Terms or your use of the App should first be raised with us through a support ticket, so we can try to resolve it directly. If it isn't resolved that way, the parties agree to first attempt resolution through arbitration or mediation before going to court, to the extent permitted under applicable EU consumer protection law - nothing in this section limits any mandatory rights you have as a consumer under applicable law.

16. Changes to these Terms

We may update these Terms as the App evolves. If we make a substantial change, you will be asked to re-confirm them the next time you log in - the app will not let you continue without that confirmation. The last-updated date is shown at the top of this page.
